Bankruptcy basics: a neutral overview
Bankruptcy is a legal option some people choose when debt is impossible to repay. This is a neutral overview — not a recommendation.
Education only. Not legal advice, not a determination of your rights, and not a recommendation to take any action. Facts, contracts, deadlines, and current law can change the outcome. For your situation, talk to a qualified professional.
What bankruptcy is
Bankruptcy is a court process that may discharge (cancel) some debts while protecting certain property. There are different types — commonly Chapter 7 and Chapter 13 for individuals. It has serious, long-term consequences for credit.
It is not right for everyone
Bankruptcy may not discharge all debts (for example, most recent taxes). It may not protect all property. Whether it helps depends on your income, your debts, your assets, and your goals. Only a licensed attorney can advise you.
Before you decide
- Talk to a nonprofit credit counselor (free or low-cost).
- Talk to a licensed bankruptcy attorney.
- Get free help from the U.S. Courts self-help and the U.S. Trustee Program.
- Never pay an upfront “bankruptcy preparation” fee to a non-attorney.
