Sued for a debt? File an Answer before the deadline
A lawsuit is serious — and beatable. But only if you answer the court by the deadline.
Education only. Not legal advice, not a determination of your rights, and not a recommendation to take any action. Facts, contracts, deadlines, and current law can change the outcome. For your situation, talk to a qualified professional.
Read the papers, find the date
A summons and complaint tell you who is suing you, for how much, and your deadline to respond. In many California cases the deadline is about 30 days — check your exact date. Missing it usually ends in a default judgment.
File an Answer
File a written Answer with the court, stating whether you admit, deny, or need proof of each claim. Filing an Answer does not admit the debt. It is your right to make them prove it, and to raise defenses like the time limit or mistaken identity.
Do not ignore it
More than 70% of debt lawsuits end in default judgment because people do not respond. A default judgment can lead to wage garnishment or a bank levy — and you lose the chance to defend yourself.
